Terms & Conditions

The Aston & Fincher website is provided to you subject to these Terms and Conditions. By using the website or placing an order for goods you confirm your agreement to our Terms and Conditions as set out below. All other terms and conditions, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law. Nothing in these terms and conditions shall affect the statutory rights of any consumer.

1. CONDITIONS OF USE
Aston & Fincher operate on a ‘sell to trade' only. Products are sold only on the understanding that they are to be used for the person intended by a qualified person. This means Aston & Fincher will accept no responsibility if the products are incorrect used and cause any kind of harm or damage.

Aston & Fincher therefore authorise every account and will reserve the right to refuse a customer if they are not seen as a professional salon business.

Goods are not supplied on a sale or return basis.

2. WARNING AND ACKNOWLEDGEMENT
The Products advertised/described/listed on this website are intended for professional use only, by persons with the necessary training and experience to use/store them safely. By ordering any such product you acknowledge this warning and confirm and warrant that you and any other person who may use the product have the necessary training and experience to use/store the product safely.

3. PRICING
Are those ruling at date of dispatch and are subject to alteration as may be necessary. Unless otherwise stated prices are exclusive of VAT and delivery costs.

4. PAYMENT
Payment must be made in full before goods are dispatched. All payments are to be made in UK Sterling via the HSBC portal.

5. ALTERATIONS TO ORDERS
An alteration to an order which is received after dispatch cannot be accepted. The alteration must be made via email at orders@astonandfincher.co.uk . If authorised, payment and order alteration will be processed through the website.

6. CANCELLATION OF ORDERS
Cancellation of an order which is received after dispatch cannot be accepted.

You must inform us via email at orders@astonandfincher.co.uk if you would like to cancel your order. We shall communicate with you to let you know if the order has been dispatched. Cancellation can only be accepted in the following terms:

  • The order has not yet been dispatched.

  • Only on standard products and equipment. Heavy items will have a handling charge of 10%, this includes delivery charges.

  • Furniture and equipment may have a handling charge up to 30% if the product has been ordered in specially.

7. OUT OF STOCKS
If we are unable to fulfill your complete order within 5 working days (or 8 in non-UK mainland areas), we will inform you via email. In most cases we will give you an option of sending you alternative products. If this alternative product is a cheaper item than the one you originally ordered, Aston & Fincher will refund you via the payment details you originally provided. If it a more expensive item Aston & Fincher will cover the difference.

8. DELIVERY
a) Your delivery address
You have the option to give a different delivery address to your payment card address. This means that you can have your order sent to a different address if required. The address provided for delivery should have a person available to sign for the order between 9am and 5pm Monday to Friday.

b) UK Mainland Delivery – England , Northern Ireland , Scotland , Wales
Please allow up to 5 working days from the time the order is placed. However, it is likely that you will receive your order before this.

c) UK Non-Mainland Delivery – Northern Ireland , Scilly Isles and Isle of Wight
Please allow up to 8 working days from the time the order is placed.

d) UK Non-Mainland Delivery – Scottish Isles
Please allow up to 10 working days from the time the order is placed.

e) European Delivery

If you are a European customer, please complete your order but then contact 0121 331 2000 to arrange delivery or email orders@astonandfincher.co.uk . Delivery will depend upon destination and weight of products. Please remember that we can not delivery products to countries that we are prohibited from.

f) Delivery of heavy items

Heavy items have a Fixed Delivery Charge. Each product is marked with a symbol if there is a fixed delivery charge in place. This is because the item is too heavy to fall under normal delivery instruction. These orders are usually delivered within 6-12 weeks although some items may take longer. You will be advised of an estimated delivery date 2-3 working days after your order is placed.

9. RETURNED PRODUCTS
a) Products that are faulty and products damaged in transit or sent incorrectly.

When goods have been ordered and they have been damaged in transit or are faulty, Aston & Fincher can agree their return only upon the following conditions:

  • The customer must notify Aston & Fincher by email within 5 days of receipt of the goods.

  • Authorisation for the return must be gained. A request must be made via email at orders@astonandfincher.co.uk.

  • Aston & Fincher will organise collection of the product. A replacement item will be sent at no extra charge. If the product can not be replaced a refund will be given once the faulty item has been received by Aston & Fincher.

  • The refund will be via the payment details you have previously provided with your order.

  • A refund will only be given once the parcel has been received and checked.

b) Return Exceptions

Unless the product is proven to be mechanically faulty we cannot accept the return of the following products if they have been already used. This is for health and safety purposes. Clippers, trimmers, razors, blades and scissors. Aston & Fincher have the right to change this list if required.

10. CHANGES/CORRECTIONS
We make every effort to ensure that the website is correct, but we reserve the right to change product specifications, prices, errors and omissions without prior notification. We have taken great care to ensure the accuracy of sizes, prices, images and specifications given. Whilst such details are given as a guide and in good faith, they are subject to alteration without notice.

All offers on this website are subject to stock availability and we reserve the right to restrict or refuse any order at any time.

11. GUARANTEES
Guarantees for all items and equipment are according to manufacturer's warranty. All glass items are specifically excluded from this guarantee.

Colours shown on this website are a guide only and are shown as best as possible for a computer screen. Aston & Fincher can not be held responsible for colour imperfections.

12. RETENTION OF TITLE
a) Property, legal or beneficial, in any goods supplied by the seller, shall pass to the buyer only when the seller has received full payment for all sums then owed by the buyer to the seller.

b) Goods in respect of which property has remained with the seller, shall be kept identifiable as those of the seller, and the buyer shall at its own expense immediately return such goods to the seller, or permit the seller to enter into the buyer's premises to collect such goods should the seller so request.

c) Risk shall pass to the buyer with possession of the goods.

13. INTELLECTUAL PROPERTY
The content of the Aston & Fincher website is protected by copyright, trademarks, database and other intellectual property rights. You may not reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content without written permission from Aston & Fincher Ltd.

No licence is granted to you in these Terms and Conditions to use any trade mark of Aston & Fincher Ltd or its affiliated companies including, without limitation, the trade marks ASTON & FINCHER, astonandfincher.co.uk, Hara Professional, Hara Beauty or Hara.

To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Aston & Fincher website. Nothing in these Terms and Conditions shall exclude Aston & Fincher Ltd liability for personal injury or death caused by its negligence.

14. APPLICABLE LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

15. INTERNATIONAL USE
Aston & Fincher Ltd makes no promise that products or materials on the Website are appropriate or available for use in locations outside the United Kingdom.

16. MISCELLANEOUS
You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

If you breach these Terms and Conditions and Aston & Fincher Ltd ignores this, Aston & Fincher Ltd will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. Aston & Fincher Ltd shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control. A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
